The article seeks to analyze the effects of the American Convention on Human Rights on Brazil's conduct in determining responsibilities in the Genivaldo dos Santos case of police violence, in comparison with similar cases of human rights violations due to lethal police actions, as well as in the conduct of the procedures of criminal prosecution that may constitute non-compliance with positive obligations, analyzing the possibility of condemning Brazil before the international community.
