The Regulatory Framework for Crypto-Assets in the European Union

Resumo

This article offers a comprehensive analysis of the legal regulation of crypto-assets in the European Union (EU). It examines the principal EU legislative instruments in this field, including Regulation (EU) 2023/1114 on Markets in Crypto-Assets (MiCA); Regulation (EU) 2023/1113 on information accompanying transfers of funds and certain crypto-assets (the Transfer of Funds Regulation, or TFR), which introduces the EU Travel Rule; Regulation (EU) 2024/1624 on the prevention of the use of the financial system for the purposes of money laundering or terrorist financing (AMLR); Regulation (EU) 2024/1620 establishing the European Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA); Regulation (EU) 2022/2554 on the digital operational resilience of the financial sector (DORA); and Regulation (EU) 2022/858 on a pilot regime for market infrastructures based on distributed ledger technology (the DLT Pilot Regime). The article concludes that the European Union’s legal framework for crypto-assets represents a systematic, comprehensive, and balanced approach to regulation.
